The exemption in sub-paragraph (1) ceases to apply immediately after the occurrence of any of the following:(a)if the Combined Cycle Gas Turbines are in operation, but the Open Cycle Gas Turbines are not in operation, in the relevant premises — the noise level emitted from the relevant premises, measured over any period of 5 minutes during a prescribed session at any point at or about ground level along a boundary of the relevant premises set out in the first column of Part 1 of the Schedule, exceeds the maximum boundary noise level set out for the prescribed session in the second column of Part 1 of the Schedule (read with sub‑paragraph (3)) corresponding to that boundary;(b)if both the Combined Cycle Gas Turbines and the Open Cycle Gas Turbines are in operation in the relevant premises — the noise level emitted from the relevant premises, measured over any period of 5 minutes during a prescribed session at any point at or about ground level along a boundary of the relevant premises set out in the first column of Part 2 of the Schedule, exceeds the maximum boundary noise level set out for the prescribed session in the second column of Part 2 of the Schedule (read with sub‑paragraph (3)) corresponding to that boundary;(c)the aggregate exceedance duration exceeds 700 hours at any time during a specified 12‑month period. Illustration The relevant specified 12‑month period is 7 May 2025 to 6 May 2026 (both dates inclusive). On 15 March 2026, at 10 p.m., the aggregate exceedance duration exceeds 700 hours. The exemption ceases to apply immediately after 10 p.m. on 15 March 2026.
