—(1) An employer who has been issued a certificate of insurance in accordance with regulation 4 and the insurer who issued the certificate of insurance must produce a copy of the certificate to the Commissioner or any investigation officer when required to do so by the Commissioner or investigation officer, as the case may be.(1A) A platform operator who has been issued a certificate of insurance in accordance with regulation 5B and the insurer who issued the certificate of insurance must produce a copy of the certificate to the Commissioner or any investigation officer when required to do so by the Commissioner or investigation officer, as the case may be.(2) A person who contravenes paragraph (1) or (1A) shall be guilty of an offence and shall be liable on conviction —(a)to a fine not exceeding $2,000; or(b)if the person is a repeat offender, to a fine not exceeding $4,000.(3) In paragraph (2)(b), “repeat offender”, in relation to an offence under paragraph (2), means a person who —(a)is convicted, or found guilty, of an offence under paragraph (2); and(b)has been convicted, or found guilty, of an offence under paragraph (2) on at least one other earlier occasion, whether the conviction was before, on or after 15 October 2024.
