—(1) An application made under section 57(1) of the Civil Aviation Authority of Singapore Act 2009 (called in this regulation the CAAS Act) for approval for a person to become a 5% controller or an indirect controller of an airport licensee or a designated business trust (each called X) is treated as an application under section 66(1)(a) or (3) (as the case may be) of the amended CAAS Act for the person to become a 5% controller or an indirect controller of X as a designated operating entity, if —(a)X is designated as a designated operating entity on 1 April 2025;(b)the application under section 57(1) of the CAAS Act is either —(i)made before 1 April 2025 and is still pending as of that date; or(ii)made between 1 April 2025 and 14 April 2025 (both dates inclusive); and(c)the person is to become a 5% controller or an indirect controller of X on or after 15 April 2025. (2) An approval given under section 57(1) of the CAAS Act for a person to become a 5% controller or an indirect controller of an airport licensee or a designated business trust (each called X) on or after 15 April 2025 is treated as an approval given under section 66(4) of the amended CAAS Act to the person to become a 5% controller or an indirect controller of X as a designated operating entity, if X is designated as a designated operating entity on 1 April 2025. (3) In this regulation —“5% controller”, “designated operating entity” and “indirect controller” have the meanings given by section 56A(1) of the amended CAAS Act;“airport licensee” and “designated business trust” have the meanings given by sections 2(1) and 63(1) of the CAAS Act, respectively;“amended CAAS Act” means the CAAS Act as amended by Part 2 of the Transport Sector (Critical Firms) Act 2024.
