Section 65

Taking person performing duty to sea

(1)

If any person performing his or her duties or functions under this Act is taken to sea in a ship without his or her consent, the shipowner and the master shall each be guilty of an offence and shall each be liable on conviction to a fine not exceeding $10,000.

(2)

Upon the conviction of the shipowner and the master for an offence under subsection (1), the shipowner and the master are jointly and severally liable to pay all expenses incidental to the person’s return to duty.
