Clause 1

Short title and commencement

This Act may be cited as the Administration of Muslim Law (Amendment) Act 1984 and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Clause 2

Amendment of section 2

Section 2 of the Administration of Muslim Law Act (referred to in this Act as the principal Act) is amended by inserting, immediately after the definition of “wali”, the following definition:“ “Yayasan Mendaki” means the body known as Yayasan Mendaki registered under the Societies Act (Cap. 262);”.

Repeal and re-enactment of section 75B

Section 75B of the principal Act is repealed and the following section substituted therefor:“Application of Mosque Building and Mendaki Fund75B.—

(1)

The monies in the Mosque Building and Mendaki Fund shall be used —

(a)

for the purpose of building mosques in Singapore;

(b)

for the payment of contributions to Yayasan Mendaki; and

(c)

for the payment of expenses incurred in maintaining and administering that Fund.(2) The Majlis shall as soon as practicable pay to Yayasan Mendaki the net amount of the contributions received for the purpose of Yayasan Mendaki, after taking into account the appropriate expenses referred to in subsection (1)(c).”.

Clause 4

Amendment of section 75C

Section 75C of the principal Act is amended —

(a)

by deleting the words “a contribution of the amount” in subsection (1) and substituting the words “contributions as”; and

(b)

by inserting, immediately after subsection (7), the following subsection:“(8) Any excess contribution paid into the Mosque Building and Mendaki Fund under subsection (6) shall, unless the employee making the contribution otherwise indicates, be deemed to be for the purpose of building mosques.”.

Miscellaneous amendments

The following provisions of the principal Act are amended by deleting the words “Mosque Building Fund” wherever they appear therein and substituting in each case the words “Mosque Building and Mendaki Fund”:Sections 2, 75A, 75C, 75D, 75E and 75F.

Repeal and re-enactment of Schedule

The Schedule to the principal Act is repealed and the following Schedule substituted therefor:“THE SCHEDULESection 75C(1).The amount of contributions payable to the Mosque Building and Mendaki Fund shall be —

(a)

$1 for the purpose of building mosques; and

(b)

50 cents for Yayasan Mendaki.”.
