Clause 9

Enforcement of awards under other provisions of law

(1)

Except as provided in subsection (1), nothing in this Act shall affect the right of any person to enforce an arbitral award otherwise than as is provided for in this Act.

(2)

Notwithstanding section 3(5) of the Reciprocal Enforcement of Commonwealth Judgments Act (Cap. 24), where a Convention award is both enforceable under this Act and registrable as a judgment under the Reciprocal Enforcement of Commonwealth Judgments Act, proceedings to enforce the award under this Act may be commenced without any disentitlement to recover any costs of the proceedings, unless otherwise ordered by the court.

(3)

Notwithstanding section 7 of the Reciprocal Enforcement of Foreign Judgments Act (Cap. 25), proceedings to enforce a Convention award under this Act may be commenced where the award is both enforceable under this Act and registrable as a judgment under the Reciprocal Enforcement of Foreign Judgments Act.
