Clause 51

Amendment of section 8

Section 8 of the Supreme Court of Judicature Act is amended —

(a)

by deleting the words “in camera” wherever they appear in subsections (2), (5) and (6) and in the section heading and substituting in each case the words “in private”;

(b)

by inserting, immediately after the word “propriety,” in subsections (2), (2A) and (6), the words “the national interest or national security of Singapore,”;

(c)

by inserting, immediately after subsection (2), the following subsections:“(2AA) Any application for a matter or proceeding to be held in private, on the grounds that it is expedient in the national interest or national security of Singapore to do so, is to be heard in private.(2AB) The court has the power to hear any application mentioned in subsection (2AA), or any part of such an application, otherwise than in private, if the court is satisfied that —

(a)

it is expedient in the interests of justice to hear the application or part of the application otherwise than in private; and

(b)

it is not prejudicial to the national interest or national security of Singapore to hear the application or part of the application otherwise than in private.”;

(d)

by deleting the word “or” at the end of subsection (2A)(a);

(e)

by deleting the comma at the end of paragraph (b) of subsection (2A) and substituting the word “; or”, and by inserting immediately thereafter the following paragraph:“(c)any information that, if disclosed, may be prejudicial to the national interest or national security of Singapore,”;

(f)

by deleting the word “or” at the end of subsection (3)(a);

(g)

by deleting the words “such a witness.” in subsection (3)(b) and substituting the words “any witness mentioned in paragraph (a); or”; and

(h)

by inserting, immediately after paragraph (b) of subsection (3), the following paragraph:“(c)publish any information relating to any matter or proceeding before the court that, if disclosed, may be prejudicial to the national interest or national security of Singapore.”.
