Clause 33

Part 9A of the Environmental Protection and Management Act 1999 does not apply to any industrial plant works for which a clearance certificate under section 33 of that Act as in force immediately before the date of commencement of sections 16 and 31 (called in this section the commencement date), has been issued before that date.

Section 33 of the Environmental Protection and Management Act 1999 and section 26A of the Energy Conservation Act 2012, as in force immediately before the commencement date, continue to apply to the industrial plant works mentioned in subsection (1).

For a period of 2 years after the date of commencement of any provision of this Act, the Minister may, by regulations, prescribe such additional provisions of a saving or transitional nature consequent on the enactment of that provision as the Minister may consider necessary or expedient.
