Clause 10

by deleting the words “developer of any building works and any qualified person, site supervisor or builder” in subsection (3) and substituting the word “person”; and

by inserting, immediately after subsection (3), the following subsection:“(4) In proceedings for an offence under subsection (3) —

it is not necessary for the prosecution to prove that an accused knew that the building works concerned deviate in any material way from any plans of the building works approved by the Commissioner of Building Control under this Part; but(b)it is a defence to the charge for the accused to prove, on a balance of probabilities, that the accused did not know and could not reasonably have known the plans of those building works approved by the Commissioner of Building Control under this Part.”.
