Regulation 2
Compoundable offences
The following offences may be compounded by the Commissioner of Building Control in accordance with section 48 of the Act:
an offence under section 7A(6), 8(4), 9(11), 10(9), 12(6), 13(2) or (3), 17(9), 22AA(4), 22B(2), 22DA(2)(a), 22E(5), 25C(1), 25E(7), 25H(1), 28(10) or 33(4A) of the Act, other than a continuing offence under section 7A(6), 12(6), 22AA(4), 22B(2), 22DA(2)(a), 22E(5) or 25E(7);
(aa)an offence under —
section 43(2) of the Act as in force before 1 January 2022; or
section 43(7) of the Act as in force on or after that date;
(ab)an offence under section 28(5A) of the Act but not a continuing offence mentioned in section 28(5A)(b) of the Act;
(ac)an offence under section 28(9) of the Act but not a continuing offence mentioned in that section;
(ad)an offence under —
section 22FB(9)(a), 22FD(4), 22FE(6), (7) or (8)(a), 22FF(4), 22FH(2)(a) or 22FJ(3) of the Act, other than a continuing offence under section 22FE(6) or 22FF(4), as in force before 30 September 2025; or
section 22FF(3), 22FG(3), 22FL(4), 22FM(3) or (4), 22FN(4)(a), 22FO(6), 22FQ(4), 22FR(3), 22FS(2), 22FT(4), 22FU(4), 22FX(9)(a), 22FZ(4), 22FZA(6), (7) or (8)(a), 22FZB(4) or 22FZC(2)(a) of the Act, other than a continuing offence under section 22FM(3), 22FO(6), 22FQ(4), 22FS(2), 22FT(4), 22FU(4), 22FZA(6) or 22FZB(4), as in force on or after 30 September 2025;
(ae)an offence under section 8(4) of the Act in relation to the contravention of regulation 20(3)(b) of the Building Control (Fixed Installations) Regulations 2025 (G.N. No. S 614/2025);
(af)an offence under section 8(5) of the Act in relation to the contravention of regulation 20(4) of the Building Control (Fixed Installations) Regulations 2025;
(ag)an offence under section 9(8) of the Act in relation to the contravention of regulation 21(1)(a) or (2)(b) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
(ah)an offence under section 9(8A) of the Act in relation to the contravention of regulation 21(3) of the Building Control (Fixed Installations) Regulations 2025;
(ai)an offence under section 9(9) of the Act in relation to the contravention of regulation 21(4)(a) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
an offence under section 9(10) of the Act in relation to the contravention of section 9(4)(d) or (e) of the Act or regulation 21(1)(b), (4)(b), (c) or (d) or (6) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
(ba)an offence under section 9(11) of the Act in relation to the contravention of regulation 21(5) of the Building Control (Fixed Installations) Regulations 2025;
(bb)an offence under section 11(6) of the Act in relation to the contravention of regulation 22(3)(a) of the Building Control (Fixed Installations) Regulations 2025;
an offence under section 11(7) of the Act in relation to the contravention of section 11(1)(c) of the Act or regulation 22(1)(a) or (3)(b) or (d) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
an offence under section 11(9) of the Act in relation to the contravention of section 11(1)(e), (f), (g) or (h), (2)(aa) or (c) or (4) of the Act or regulation 22(1)(b), (c) or (d), (2), (3)(c), (e), (f), (g), (h) or (i) or (4) of the Building Control (Fixed Installations) Regulations 2025;
an offence under section 20(1) of the Act in relation to the contravention of regulation 24(1)(b) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
(ea)an offence under section 20(2) of the Act in relation to the contravention of regulation 24(2) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
(eb)an offence under section 20(3) of the Act in relation to the contravention of regulation 24(3) of the Building Control (Fixed Installations) Regulations 2025;
an offence under regulation 6(2), 9(4), 10(3), 16(4), 17(3), 18(7), 19(5) or 20(4) of the Building Control (Temporary Buildings) Regulations 2018 (G.N. No. S 807/2018);
an offence under regulation 12 of the Building Control (Outdoor Advertising) Regulations (Rg 6);
an offence under regulation 41B(3), 41C(4), 41D(3), 41E(2), 44B(3) or 44C(3) of the Building Control Regulations 2003 (G.N. No. S 666/2003);
an offence under regulation 50 of the Building Control Regulations 2003;
(ia)an offence under regulation 50 of the Building Control Regulations 2003 in relation to the contravention of regulation 29(1) or (2) of those Regulations as in force before 1 October 2025;
(ib)an offence under regulation 50 of the Building Control Regulations 2003 in relation to the contravention of regulation 7, 22(5) or 23(1) or (2) of the Building Control (Fixed Installations) Regulations 2025;
an offence under regulation 21(7) (in relation to the contravention of regulation 21(1)(d)), 28(3), 29(10), 32(9), 33(7), 34(2), 35(4), 36(4), 37(3), 38(3), 39(7), 41(6) or (7) or 42(5) of the Building Control (Fixed Installations) Regulations 2025, other than a continuing offence;
an offence under paragraph 6(2) or 7(2) of the Building Control (Retrofitting of Casement Windows) Order 2004 (G.N. No. S 599/2004);
an offence under regulation 2(2) of the Building Control (Use of Buildings Under Construction as Workers’ Quarters) Regulations 2008 (G.N. No. S 636/2008);
an offence under regulation 16(2) or 20E(3) of the Building Control (Licensing of Builders) Regulations 2008 (G.N. No. S 641/2008); (m)an offence under regulation 15 of the Building Control (Buildability) Regulations 2011 (G.N. No. S 199/2011) in relation to the contravention of regulation 8(1), 9(1) or (2), 10, 12(a), 13(1) or 14(1) of those Regulations;
an offence under regulation 3(2), 4(2), 5(3), 12(2), 13(2) or 14(3) of the Building Control (Periodic Inspection of Buildings and Building Façades) Regulations 2021 (G.N. No. S 785/2021).
