Day surgical treatment
Subregulation 1
Despite anything in this Part but subject to regulation 12, where a member or the member’s dependant has received medical treatment (other than any approved vaccination) and undergone any day surgical treatment from an approved medical practitioner in an approved hospital or an approved day surgery centre, the amount that may be withdrawn by the member for —
the payment of attendance fees of the approved medical practitioner or practitioners must not exceed $30 per day, if the member or the member’s dependant was admitted to the approved hospital or approved day surgery centre before 1 November 2018;
the payment of hospital charges, including attendance fees, must not exceed the relevant sum per day;
the payment of operation fees for a maximum of 3 surgical procedures, involving not more than 2 anatomical systems and not more than 2 procedures within each system, must not exceed the lower of the following cap amounts:
the amount as determined by the Minister for Health for such operation or operations;
for day surgical treatment received —
before 1 June 2009 — $5,000;
on or after 1 June 2009 but before 1 April 2025 — $7,550; or
on or after 1 April 2025 — $5,290;
the payment of radiosurgery treatment must not exceed —
$7,500 per course of treatment if the treatment started on or after 1 January 2008 but before 1 April 2025; (ii)$3,750 per course of treatment if the treatment started on or after 1 April 2025 but before 1 June 2026; or
the relevant sum per day (as part of the hospital charges under sub-paragraph (b)) if the treatment started on or after 1 June 2026; and
the payment of the medical treatment —
must not exceed the total expenditure for the medical treatment; and
must not exceed the total credit balance in the member’s medisave account.
Subregulation 2
In paragraph (1)(b), the relevant sum per day is —
$150 if the member or dependant received the day surgical treatment before 1 December 2006;
$200 if the member or dependant received the day surgical treatment on or after 1 December 2006 but before 1 May 2007;
$300 if the member or dependant received the day surgical treatment on or after 1 May 2007 but before 1 April 2025; and
$830 if the member or dependant received the day surgical treatment on or after 1 April 2025.
Subregulation 3
Any withdrawal by a member under this regulation is subject to such terms and conditions as the Minister for Health may impose.
