Regulation 20
False representation as to registered charity
Subregulation 1
A person commits an offence if —
the person solicits money or other property for the benefit of an institution;
the person represents that the institution is a registered charity even though the institution is not; and
the person knows or ought reasonably to know that, or is reckless as to whether, the representation mentioned in sub-paragraph (b) is false or misleading.
Subregulation 2
A person who is guilty of an offence under paragraph (1) shall be liable on conviction —
to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 years or to both; and
in the case of a continuing offence, to a further fine not exceeding $100 for every day or part of a day during which the offence continues after conviction.
