Clause 71

Amendment of Probation of Offenders Act

The Probation of Offenders Act (Cap. 252, 1985 Ed.) is amended —

(a)

by deleting the words “16 years” in sections 5(1) (paragraph (a) of the proviso), 8(1) (paragraph (a) of the proviso) and 11(1) (proviso) and substituting in each case the words “18 years”;

(b)

by deleting the words “14 years” in sections 5(4) and 6(3) and substituting in each case the words “18 years”; and

(c)

by deleting subsection (4) of section 10 and substituting the following subsection:“(4) Where a court makes any order under this section and the offender is below 18 years of age, the order must be enforced against the offender’s parent or guardian, unless the court is satisfied that the parent or guardian cannot be found or that the parent or guardian has not contributed to the commission of the offence by the offender by neglecting to exercise due care over the offender.”.
