Amendment of section 169

Section 169 of the Companies Act is amended —

(a)

by deleting the words “alter or add to its articles so as to” in subsection (1) and substituting the words “or otherwise”;

(b)

by inserting at the end of subsection (1), the words “and any resolution passed in breach of this section shall be void”; and

(c)

by deleting the words “Alteration of articles so as to improve” in the marginal note and substituting the words “Provision and improvement of”.
