Amendment of section 65
Section 65 of the Competition Act is amended —
(a)
by deleting the words “an investigating officer or inspector” in subsection (1)(c) and substituting the words “an investigating officer, an authorised person, an inspector or a person required by the inspector”;
(b)
by deleting the words “the named officer” in subsection (2) (vii) and substituting the word “he”; and
(c)
by deleting subsection (5) and substituting the following subsection:“(5) A named officer may allow any equipment or article which has a bearing on an investigation and which may be removed from any premises for examination under subsection (2)(viii) to be retained on those premises subject to such conditions as the named officer may require.”.
