Repeal and re-enactment of Article 131

Article 131 of the Constitution of Malaysia is hereby repealed and the following substituted therefor: —“Appeals to Judicial Committee of the Privy Council131.—

(1)

The President may make arrangements with Her Britannic Majesty for the reference to the Judicial Committee of Her Britannic Majesty’s Privy Council of appeals from the Appellate Court in Singapore, and subject to the provisions of this Article, an appeal shall lie from that Court to the Judicial Committee of Her Britannic Majesty’s Privy Council in any case in which such an appeal is allowed by any law in force in Singapore, and in respect of which provision for reference to the said Committee is made by or under the enactments regulating the proceedings of the said Committee.(2) Any appeal under this Article shall be subject to such conditions as to leave or otherwise as may be prescribed by any law in force in Singapore or by or under the enactments regulating the proceedings of the Judicial Committee of Her Britannic Majesty’s Privy Council.(3) Provision may be made by law for the enforcement of the orders of the Judicial Committee of Her Britannic Majesty’s Privy Council in regard to appeals referred to it under this Article or any other written law in force in Singapore.(4) In this Article “Appellate Court” means such court as, in accordance with the laws for the time being in force, has jurisdiction to hear appeals from the High Court in Singapore or a judge thereof and includes the Federal Court of Malaysia.”.
