Regulation 43

Power to require documents and information

Subregulation 1

If IPOS has reason to believe that a person is carrying on business as a CMO, IPOS may, by written notice, require the person (or, in the case of an entity, a key officer of the entity) to produce any information or document to assist IPOS in ascertaining whether the person is in fact carrying on business as a CMO.

Subregulation 2

IPOS must not require the production of any information or document that is subject to legal privilege.

Subregulation 3

A person who fails to comply with a written notice under paragraph (1) commits an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both.
