Amendment of section 4

Section 4 of the Development Fund Ordinance, 1959 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —

(a)

by deleting the words “or that a need has arisen for expenditure for a purpose for which no amount has been appropriated in accordance with subsection (2) of this section” appearing in subsection (3) thereof;

(b)

by inserting immediately after the word “section” appearing in the fourth line of subsection (5) thereof the words “or to create a new sub-head”;

(c)

by inserting immediately after the word “deficient” appearing in the eighth line of subsection (5) thereof the words “or of any new sub-head”; and

(d)

by deleting subsection (6) thereof.

The Ordinance is hereby amended by inserting immediately after section 5 thereof the following new section: —“Contingencies Fund6.—

(1)

A Contingencies Fund is hereby created consisting of moneys from time to time appropriated thereto from the Development Fund.(2) The Minister for Finance may, if he is satisfied that there has arisen an urgent and unforeseen need for expenditure for which no other provision exists and for which funds cannot be provided under the provisions of subsection (5) of section 4 of this Ordinance, make advances from the Contingencies Fund to meet such need.(3) Where any advance is made by virtue of the authority conferred under subsection (2) of this section, a supplementary estimate of the sum required to replace the amount so advanced shall, as soon as practicable, be laid before Parliament for approval in accordance with subsection (3) of section 4 of this Ordinance.”.

(1)

The following provisions of the Ordinance are hereby amended by deleting the words “the Legislative Assembly” and “The Legislative Assembly” wherever they appear therein and substituting therefor the word “Parliament”: —Sections 3, 4(1), 4(2), 4(3) and 5.

The following provisions of the Ordinance are hereby amended by deleting the words “the State of” wherever they appear therein: —Section 2 and paragraphs 1 and 3 of the Schedule.
