Clause 49

Public nuisances to be abated

(1)

Except as provided in subsection (2) of this section, the Commissioner shall take such steps as he may deem necessary to remove or abate all nuisances of a public nature and may, if he considers that the circumstances so warrant, proceed at law against any person committing any such nuisance.

(2)

Where any nuisance specified in paragraph (a), (e)(ii), (e)(iii), (f), (g) or (k) of subsection (1) of section 50 of this Act arises from any want or defect of a structural character, the Chief Building Surveyor shall take such steps as he may deem necessary to remove or abate the same and may, if he considers that the circumstances so warrant, proceed at law against any person committing any such nuisance, and for this purpose every reference to the Commissioner in subsections (1), (2) and (4) of section 51, subsections (1), (11) and (14) of section 52, subsection (1) of section 53 and subsection (2) of section 54 of this Act shall be construed as a reference to the Chief Building Surveyor.
