Clause 37

Amendment of section 97

Section 97(2) of the principal Act is amended —

(a)

by deleting the word “licence” in paragraph (a)(ii) of the definition of “misconduct” and substituting the words “financial adviser’s licence”;

(b)

by deleting the word “or” at the end of sub-paragraph (iia) of paragraph (a) of the definition of “misconduct”, and by inserting immediately thereafter the following sub-paragraph:“(iib)any condition or restriction imposed on an appointed or provisional representative under section 23K; or”; and

(c)

by deleting the definition of “relevant person” and substituting the following definition:“ “relevant person” means any licensed financial adviser, exempt financial adviser, representative, or officer or partner of a licensed financial adviser or an exempt financial adviser.”.
