Penalties for offences for unlicensed regulated activities involving weapons or noxious substances

Clause 34
A person who is guilty of an offence under section 29(1), 30(1) or (2), 31, 32(1) or 33(1) or (3) shall on conviction be punished with —
(a)
if a prohibited weapon is involved —
(i)
where the person is an individual — imprisonment for a term not exceeding 36 months and a fine not exceeding $40,000; or
(ii)
in any other case — a fine not exceeding $80,000; or
(b)
if a noxious substance or a weapon other than a prohibited weapon is involved —
(i)
where the person is an individual — imprisonment for a term not exceeding 24 months and a fine not exceeding $20,000; or
(ii)
in any other case — a fine not exceeding $40,000.
