Clause 34

Production of transit permits

(1)

This section shall apply if the Director or an authorised officer has reasonable grounds for suspecting that a person (the suspected person) —

(a)

intends to carry out a transit proposal;

(b)

is carrying out a transit proposal; or

(c)

has carried out a transit proposal.

(2)

The Director or an authorised officer may require the suspected person to produce, or to produce evidence of the existence and contents of, a transit permit authorising the carrying out of the transit proposal.

(3)

Any suspected person who refuses or fails, without reasonable excuse, to comply with the requirement shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000.
