Clause 11
Section 14 of the principal Act is amended —
(a)
by deleting the words “Before modifying any condition of a licence” in subsection (2) and substituting the words “Subject to subsection (5)”; (b)by inserting, immediately after the word “must” in subsection (2), the words “, before modifying any condition of a licence,”; and
(c)
by inserting, immediately after subsection (4), the following subsection:“(5) Subsection (2) does not apply in relation to any modification of a licence condition that —
(a)
applies to one or more classes of licensees; and
(b)
is necessary to prevent or mitigate immediate or imminent harm to patient safety.”.
