Licensees required to appoint CEC
Subregulation 1
For the purposes of section 25 of the Act, every licensee authorised to provide an acute hospital service must, in accordance with paragraph (2), appoint one or more clinical ethics committees.
Subregulation 2
A CEC appointed to conduct an ethics review must comprise —
at least 6 members who are healthcare professionals each with at least 10 years of practice experience and who are in active practice, of whom at least 3 must each be an independent member; and
at least 3 other members who are not healthcare professionals.
Subregulation 3
In this regulation, “independent member”, in relation to a licensee appointing a CEC to conduct an ethics review, means a member of the CEC —
who is not employed by the licensee; and
who does not have any interest (whether personal, professional or otherwise) in the outcome of the ethics review.
