Amendment of section 80

Section 80 of the principal Act is amended by deleting subsection (1) and substituting the following subsections:“(1) In addition to the powers conferred on him by this Act or any subsidiary legislation made thereunder, an officer or employee of the Board may, in relation to any offence under this Act or such subsidiary legislation, on declaration of his office and production to the person against whom he is acting such identification card as the Chief Executive Officer may direct to be carried by officers or employees of the Board —

(a)

require any person whom he reasonably believes to have committed that offence to furnish evidence of the person’s identity;

(b)

require any person to furnish any information or produce any book, document or other record or a copy thereof in the possession of that person, and may, without fee or reward, inspect, make copies of or take extracts from such book, document or other record; or

(c)

require, by order in writing, the attendance before the officer or employee of any person within the limits of Singapore who, from any information given or otherwise obtained by the officer or employee, appears to be acquainted with the circumstances of the case.(1A) Where any such record mentioned in subsection (1)(b) is kept in electronic form, then —

(a)

the power of an officer or employee of the Board under subsection (1) to require any such record to be produced for inspection includes power to require a copy of the record to be made available for inspection in legible form; and

(b)

the power of any officer or employee of the Board under subsection (1) to inspect any such record includes power to require any person in question to give the officer or employee such assistance as he may reasonably require to enable him —

(i)

to inspect and make copies of the record in legible form or to make a record of information contained in that record; or

(ii)

to inspect and check the operation of any computer, and any associated apparatus or material, that is or has been in use in connection with the keeping of that record.(1B) Any person who —

(a)

refuses to give access to, or assaults, obstructs, hinders or delays, an officer or employee of the Board in the discharge of the duties by such officer or employee of the Board under this Act or any subsidiary legislation made thereunder;

(b)

wilfully mis-states or without lawful excuse refuses to give any information or produce any book, document or other record or a copy thereof required of him by an officer or employee of the Board under subsection (1); or

(c)

fails to comply with a lawful demand of an officer or employee of the Board in the discharge by such officer or employee of his duties under this Act or any subsidiary legislation made thereunder,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 3 months or to both.”.
