Clause 45
Where the appointment of any person as trustee in bankruptcy fails to take effect, or where a vacancy arises in the office of a trustee in bankruptcy whose appointment has taken effect, the Official Assignee —
(a)
is to act as the trustee of the bankrupt’s estate until the vacancy is filled; and
(b)
may summon a general meeting of the bankrupt’s creditors for the purpose of filling the vacancy.
