Clause 90

Application to Court for company to be placed under judicial management and for appointment of judicial manager

Where a company, or any creditor of the company, considers —

(a)

that the company is, or is likely to become, unable to pay its debts; and

(b)

that there is a reasonable probability of rehabilitating the company or of preserving all or part of its business as a going concern, or that the interests of creditors would be better served otherwise than by resorting to a winding up,an application may be made to the Court under section 91 for an order that the company should be placed under the judicial management of a judicial manager.
