Regulation 34

Proxy of creditor who is blind or incapable of writing

Subregulation 1

The instrument of proxy of a creditor who is blind or incapable of writing may be accepted, if the creditor has signed or inserted his or her mark on the instrument in the presence of a witness.

Subregulation 2

This applies only if the witness —

(a)

writes the information on the instrument of proxy;

(b)

certifies at the foot of the instrument of proxy —

(i)

that the information has been written at the creditor’s request; and (ii)the creditor has made the request in the presence of the witness before the creditor signed or inserted his or her mark on the instrument; and (c)signs and provides his or her name and residential address on the instrument of proxy.
