Historical Base Value as in 2003

Subregulation 1

In this Order, the “Historical Base Value as in 2003” of any land means the higher of the value of the following developments on the land calculated using the 2003 DC rules as modified by sub‑paragraph (2):

(a)

any development for which that land was allocated in the 1958 Master Plan (which the 2003 DC Rules term as the development referred to in section 36(1)(a) of the 2003 Planning Act);

(b)

any development for which that land was allocated in the 1982 Master Plan (which the 2003 DC Rules term as the development referred to in section 36(1)(b) of the 2003 Planning Act).

Subregulation 2

In determining the Historical Base Value as in 2003 of any land —

(a)

where the value of such development on the land as is referred to in sub‑paragraph (1)(a) or (b) cannot be ascertained, the Historical Base Value as in 2003 of the land has then to be determined without reference to that development; and

(b)

where no maximum permissible plot ratio was prescribed in the 1958 Master Plan or 1982 Master Plan for the land zoned for any purpose, the plot ratio specified in the Second Schedule opposite the purpose for which the land was zoned in the 1958 Master Plan or 1982 Master Plan (as the case may be) must apply, provided that the land is not being used as a golf course as at the date of an application for written permission for the development of the land mentioned in paragraph 16(1).
