Clause 38
Section 89 of the principal Act is amended by deleting subsection (2) and substituting the following subsection:“(2) This section shall not entitle a mortgagee to refuse to produce the document of title (if in his custody) to enable a lease by the mortgagor to be registered, but the production by a mortgagee of the document of title shall not imply a consent to the lease.”.
