Amendment of section 105
Section 105 of the principal Act is amended by deleting subsection (2) and substituting the following subsection:“(2) A Disciplinary Tribunal may —
(a)
where the person whose conduct is the subject of inquiry does not appear before the Tribunal, and the Tribunal decides under section 104 to proceed in that person’s absence; or
(b)
with the consent in writing of the person whose conduct is the subject of inquiry,proceed and act on evidence by affidavit or statutory declaration, either as to the whole case or as to any particular fact or facts.”.
