Short title and application

This Act may be cited as the Limitation (Amendment) Act, 1966.(2) Nothing in sections 3 and 4 of this Act shall affect any action or proceeding, if the cause of action arose before the coming into operation of this Act.

Clause 2

Amendment of section 2

Subsection (1) of section 2 of the Limitation Ordinance, 1959 (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —

(a)

by deleting the definition of “Government” appearing therein; and

(b)

by inserting in the appropriate place therein the following new definition: —“ “personal injuries” includes any disease and any impairment of a person’s physical or mental condition;”.

Amendment of section 6

Section 6 of the Ordinance is hereby amended by inserting immediately after subsection (3) thereof the following new subsection: —“(3A) An action for damages for negligence, nuisance or breach of duty (whether the duty exists by virtue of a contract or of provision made or under any written law or independently of any contract or any such provision) where the damages claimed by the plaintiff for the negligence, nuisance or breach of duty consist of or include damages in respect of personal injuries to any person, shall not be brought after the expiration of three years from the date on which the cause of action accrued.”.

Amendment of section 24

Subsection (1) of section 24 of the Ordinance is hereby amended by inserting immediately after the expression “six years,” appearing in the fifth line thereof the expression “or in the case of actions to which subsection (3A) of section 6 applies, three years,”.
