Clause 66

Offences in relation to warranties

(1)

If an accused in any such proceedings as are mentioned in subsection (1) of section 65 wilfully applies to any substance or article a warranty given in relation to a different substance or article he shall be guilty of an offence.

(2)

A person who, in respect of any substance or article sold by him in respect of which a warranty might be pleaded under section 65, gives to the purchaser a false warranty in writing shall be guilty of an offence, unless he proves that when he gave the warranty he had reason to believe that the statement or description contained in it was accurate.

(3)

Any person guilty of an offence under this section shall be liable on conviction to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding two years or to both such fine and imprisonment.
