Regulation 9

False or fraudulent declaration or representation

Subregulation 1

Where a person makes any false or fraudulent declaration or representation when applying to register or register anew, or renew the registry of, a pleasure craft under these Regulations, the person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000.

Subregulation 2

In proceedings for an offence under paragraph (1) in relation to a declaration or representation, it is a defence to the charge for the accused to prove, on a balance of probabilities, that the accused took all reasonable steps, and exercised all due diligence, to ensure that the declaration or representation was not false or fraudulent.
