Consequential Amendments
SIXTH SCHEDULESection 42Consequential Amendments
1. Section 2 of the Parks and Trees Act [Cap. 216] is amended —
by inserting, immediately after the definition of “aeration”, the following definition:“ “Board” means the National Parks Board;”;
by deleting the definition of “Commissioner” and substituting the following definition:“ “Commissioner” means the Commissioner of Parks and Recreation and includes any officer authorised by the Minister to perform the duties and functions of the Commissioner under section 3(2A);”; and
by deleting the words “transferred to or has become vested in the Government under the” in the definition of “public street” and substituting the words “vested in the Government under the Street Works Act [Cap. 320A] or the repealed”.
2. Section 3 of the Parks and Trees Act is amended by deleting subsection (2) and substituting the following subsections:“(2) The Minister may appoint such number of officers as may be necessary for the purpose of administering and carrying out the provisions of this Act.(2A) The Minister may, by notification in the Gazette, authorise one or more officers appointed under subsection (2) to perform the duties and functions of the Commissioner under this Act.”.
3. The following provisions of the Parks and Trees Act are amended by deleting the word “Government” wherever it appears and substituting in each case the word “Board”:sections 5A(3) and (6), 8(2), 10(3) and (6), 11(2) and 14(4).
4. Section 15B of the Parks and Trees Act is amended by deleting “$2,000” and substituting the words “$5,000 or to imprisonment for a term not exceeding 6 months or to both”.
5. Section 16 of the Parks and Trees Act is amended by deleting subsection (2) and substituting the following subsections:“(2) On payment of such sum of money, no further proceedings shall be taken against that person in respect of that offence except that where any damage has been caused to property owned by the Government or the Board and maintained, supervised or controlled by the Commissioner under this Act, that person shall in addition be liable to make good the damage, the cost of which shall constitute a debt due from the person to the Board and be recoverable as such.(3) All sums collected under this section shall be paid into the funds of the Board.”.
6. The Parks and Trees Act is amended by inserting, immediately after section 20A, the following section:“Payment of fees and charges collected to Board20B. All fees, charges and moneys collected under this Act or any rules made thereunder shall be paid to the Board.”.
