Excess payments and refunds
Subregulation 1
Any refund of excess payment made by the Superintendent shall be made to the person who made the payment.
Subregulation 2
If the identity of the person in paragraph (1) is unknown to the Superintendent, he may request the owner of the relevant vehicle to provide information on the identity of such person and the refund under paragraph (1) shall be made to the person identified by the owner unless the Superintendent has reason to believe he is not the person who made the payment.
Subregulation 3
The owner of the vehicle shall be guilty of an offence if he willingly provides false or misleading information under paragraph (2).
Subregulation 4
No refund of excess payment shall be made where —
the identity of the person who made the payment is unknown to the Superintendent and the owner of the vehicle has not provided the necessary information within the time specified by the Superintendent; or
the owner has identified the person and no claim has been received by the Superintendent from that person within the time specified by the Superintendent to him.
