Regulation 1

Citation and commencement

These Regulations are the Parliamentary Elections (Registration of Overseas Electors) Regulations 2023 and come into operation on 1 June 2023.

Regulation 2

Definitions

Subregulation 1

In these Regulations —

Definition

“office”, in relation to the Registration Officer, means 11 Novena Rise, Elections Department, Singapore 307516;

Definition

“specified website” means the Internet website of the Elections Department at https://www.eld.gov.sg.

Subregulation 2

A reference in these Regulations to a numbered Form is —

(a)

for the purpose of submitting the Form electronically — a reference to the Form with the corresponding number on the specified website; and

(b)

for any other purpose — a reference to the Form with the corresponding number in the Schedule.

Regulation 3

Overseas registration centres

If an overseas registration centre is established under section 10(4) of the Act, the Registration Officer must cause a notice of that fact and the address of the overseas registration centre to be published in any manner and on any media that the Registration Officer thinks fit.

Regulation 4

Inspection of register at overseas registration centres

A person who wishes to inspect any register of electors at an overseas registration centre must apply to the officer in charge of the register at that overseas registration centre.

Regulation 5

Application to be registered as overseas elector

Subregulation 1

An application under section 13A(1) of the Act to be registered as an overseas elector must be made in one of the following ways:

(a)

by lodging a duly completed Form R1 in person at —

(i)

the office of the Registration Officer; or

(ii)

an overseas registration centre;

(b)

by sending a duly completed Form R1 by post to the address of —

(i)

the office of the Registration Officer; or

(ii)

an overseas registration centre;

(c)

by submitting a duly completed Form R1 using the electronic system provided by the Government for this purpose.

Subregulation 2

The Registration Officer may reject the application if —

(a)

the application is incomplete or not made in accordance with these Regulations; or

(b)

the applicant fails to provide any additional information requested by the Registration Officer under section 13A(2)(e) of the Act.

Subregulation 3

Paragraph (2) does not affect any other ground on which the Registration Officer may reject the application.

Subregulation 4

The Registration Officer must inform the applicant as soon as practicable of the outcome of the application.

Regulation 6

Application to change overseas polling station or method of voting, etc.

Subregulation 1

An application by an overseas elector under section 13A(3) of the Act must be made in one of the following ways: (a)by lodging a duly completed Form R2 in person at —

(i)

the office of the Registration Officer; or (ii)an overseas registration centre;

(b)

by sending a duly completed Form R2 by post to the address of —

(i)

the office of the Registration Officer; or

(ii)

an overseas registration centre;

(c)

by submitting a duly completed Form R2 using the electronic system provided by the Government for this purpose.

Subregulation 2

The Registration Officer may reject the application if it is incomplete or not made in accordance with these Regulations.

Subregulation 3

The Registration Officer must inform the applicant as soon as practicable of the outcome of the application.

Regulation 7

Notification by postal voter of change of signature

Subregulation 1

An overseas elector who is designated as a postal voter under section 13A(3A) of the Act must notify the Registration Officer of any change in the signature he or she intends to use for the purposes of the postal voting method.

Subregulation 2

The notification must be given in one of the following ways:

(a)

by lodging a duly completed Form R3 in person at —

(i)

the office of the Registration Officer; or (ii)an overseas registration centre;

(b)

by sending a duly completed Form R3 by post to the address of —

(i)

the office of the Registration Officer; or

(ii)

an overseas registration centre;

(c)

by submitting a duly completed Form R3 using the electronic system provided by the Government for this purpose.

Subregulation 3

The notification must be given before the start of the specified period of a presidential election or an election, as the case may be.

Subregulation 4

If the notification is received by the Registration Officer during the specified period of a presidential election or an election, the notification is to be disregarded for the purposes of that presidential election or election.

Subregulation 5

In this regulation, “specified period” has the meaning given by section 13A(6) of the Act.

Regulation 8

Notification by overseas electors of change of overseas contact particulars

An overseas elector must notify the Registration Officer of any change in his or her overseas contact particulars in one of the following ways:

(a)

by lodging a duly completed Form R4 in person at —

(i)

the office of the Registration Officer; or (ii)an overseas registration centre;

(b)

by sending a duly completed Form R4 by post to the address of —

(i)

the office of the Registration Officer; or

(ii)

an overseas registration centre;

(c)

by submitting a duly completed Form R4 using the electronic system provided by the Government for this purpose.

Regulation 9

Completion of forms, etc.

Subregulation 1

This regulation applies to all forms used for the purposes of these Regulations.

Subregulation 2

A form must be completed in the English language.

Subregulation 3

A form must be completed in accordance with any instructions —

(a)

in the form; (b)by the Registration Officer; and

(c)

if the form is to be submitted on an electronic system — on the electronic system.

Subregulation 4

If strict compliance with a form is not possible, the Registration Officer may allow for necessary modifications to be made to the form, or for the requirements of the form to be complied with in any other manner that the Registration Officer thinks fit.

Regulation 10

Forms to be made available

The forms in the Schedule must be —

(a)

made available during business hours at —

(i)

the office of the Registration Officer; and

(ii)

every overseas registration centre; and

(b)

made available, with any modifications that the Registration Officer thinks fit to make, on the specified website.

Regulation 11

Revocation

Revoke the Parliamentary Elections (Registration of Overseas Electors) Regulations (Rg 4).
