Period for filing request for search and examination report, request for examination report or request for supplementary examination report, etc.
Subregulation 1
Subject to paragraph (2), the period prescribed for filing a request for a search and examination report under section 29(1)(b) or a request for an examination report under section 29(1)(c) or (3) shall be —
subject to sub-paragraph (b), 36 months after —
the declared priority date of the application; or
where there is no declared priority date, the date of filing of the application; or
where a new application is filed under section 20(3), 26(11) or 47(4), 36 months after the actual date of filing of the new application.
Subregulation 2
Where the Registrar sends the applicant a copy of the search report under section 29(2)(b) at any time later than one month before the expiry of the period prescribed under paragraph (1)(a) or (b), as the case may be, the period prescribed for filing a request for an examination report under section 29(3) shall be one month from the date of the Registrar’s letter forwarding the copy of the search report sent under section 29(2)(b).
Subregulation 3
The period prescribed for filing a request for a supplementary examination report under section 29(1)(d) shall be —
subject to sub-paragraph (b), 54 months after —
the declared priority date of the application; or
where there is no declared priority date, the date of filing of the application; or
where a new application is filed under section 20(3), 26(11) or 47(4), 54 months after the actual date of filing of the new application.
Subregulation 4
The prescribed date mentioned in section 29(12)(a) and (b) is 1 January 2020.
