Surrender of patents

A notice of an offer under section 40 by a proprietor of a patent to surrender his patent shall be given on Form CM3.
Subregulation 2

A notice under paragraph (1) shall have no effect unless the proprietor of the patent states in the notice that each person having a right in the patent —
(a)
has been given not less than 3 months’ notice of the proprietor’s intention to surrender the patent; and
(b)
either is not affected by the surrender of the patent, or has no objection to the surrender of the patent.

The Registrar may give such directions as he may think fit with regard to any aspect of the procedure for the surrender of the patent.
