An application under section 54(3) shall be made on Patents Form 28 within 2 months from the date of publication in the journal of the relevant entry and shall be supported by a statement setting out fully the nature of the claimant’s interest and the facts upon which he relies.

The claimant shall, at the time the application is filed, serve on the proprietor of the patent a copy of the application and a copy of the statement.
