Regulation 3
Exemption of bus drivers
Subregulation 1
Section 110(1)(a) of the Act does not apply to any of the following:
a person who drives a private bus;
a person who is an employee of the owner or hirer of any of the following buses which has the approval of the Registrar for use as a private bus for a specified group of passengers and period, when driving the bus in the course of that employment and in accordance with that approval:
a private hire bus;
an excursion bus;
any person who drives the Malaysia inter‑state express bus service known as Bas Ekspres when holding a licence under the laws of Malaysia that is equivalent to a vocational licence granted under Part V of the Act to act as a bus driver;
any person who drives a bus that —
is registered under the laws of Malaysia;
is the subject of an omnibus licence granted under Part V of the Act; and
is being used to provide a passenger transport service for journeys between Johor and Singapore,when holding a licence under the laws of Malaysia that is equivalent to a vocational licence granted under Part V of the Act to act as an omnibus driver.
Subregulation 2
Section 110(1)(b) of the Act does not apply to an employer of a person exempt under any of the sub‑paragraphs of sub‑paragraph (1).
Subregulation 3
For the purpose of sub‑paragraph (1)(d), “omnibus licence” has the same meaning as in the Road Traffic (Public Service Vehicles) Rules (R 14).
