Transfer of appeal from Court of Appeal to Appellate Division (O. 18, r. 41)
Subregulation 1
For the purposes of section 29E(3) of the Supreme Court of Judicature Act, the Court of Appeal is to have regard to the following matters, in deciding whether to exercise the power in section 29E(1) of that Act on its own motion, to transfer to the Appellate Division an appeal against a decision of the General Division that has been made to the Court of Appeal:
the appeal was not made to the Court of Appeal in accordance with section 29C of that Act;
none of the legal issues raised on appeal engage any of the matters set out in the Sixth Schedule to that Act;
all of the legal issues raised on appeal in relation to the matters set out in the Sixth Schedule to that Act relate to issues of settled law.
Subregulation 2
An application under section 29E(2)(b) of the Supreme Court of Judicature Act to transfer to the Appellate Division an appeal against a decision of the General Division that has been made to the Court of Appeal —
must be made in accordance with Rule 35; and
must be filed and served within 14 days after the date of service of the notice of appeal on all parties who have an interest in the appeal.
