Clause 30

Amendment of section 97

Section 97 of the principal Act is amended —

(a)

by deleting the word “or” at the end of subsection (1)(f);

(b)

by inserting, immediately after paragraph (f) of subsection (1), the following paragraph:“(fa)has had a prohibition order under section 101A made by the Authority against him that remains in force;”;

(c)

by deleting the comma at the end of paragraph (g) of subsection (1) and substituting the word “; or”, and by inserting immediately thereafter the following paragraph:“(h)is not a fit and proper person for such office,”; and

(d)

by inserting, immediately after paragraph (a) of subsection (4), the following paragraph:“(aa)a prohibition order under section 101A has been made by the Authority, and remains in force, against the officer;”.
