Reconciliation of money and assets placed with approved clearing house

Subregulation 1

Where a member of an approved clearing house has notified the approved clearing house that the books for any money or assets deposited or paid for or in relation to a contract of a customer (referred to in this paragraph as the relevant customer) of the member are to be separated from the books for any money or assets deposited or paid for or in relation to the contracts of other customers of the member, the approved clearing house shall cause the member to submit to the approved clearing house on a quarterly basis (or at such other time as the approved clearing house may require) records setting out the amount of money and assets deposited with or paid to the approved clearing house for or in relation to the contracts of the relevant customer.

Subregulation 2

An approved clearing house shall ensure that the records it keeps in respect of the money or assets deposited or paid for or in relation to any contract or contracts of a customer of a member of the approved clearing house are subject to controls adequate to maintain the accuracy of such records, including regular reconciliation of such records with the records submitted by the member in accordance with paragraph (1).
