Regulation 31

Application for adjournment

Subregulation 1

After a plea of not guilty has been entered to any charge, the court may ask the accused whether he wishes to apply for an adjournment on the ground that —

(a)

any regulation relating to procedure before trial has not been complied with and the accused has been prejudiced thereby; or

(b)

the accused has not had sufficient opportunity for preparing his defence.

Subregulation 2

If the accused applies for an adjournment under paragraph (1) —

(a)

the accused may adduce evidence in support of his application and the prosecutor may adduce evidence in answer thereto; and

(b)

the prosecutor may address the court in answer to the application and the accused may reply to the prosecutor’s address.

Subregulation 3

The court may grant an adjournment if it thinks the interests of justice so require.
