Clause 1

Short title

This Act may be cited as the Singapore Parliament Elections (Amendment) Act, 1967.

Clause 2

Amendment of section 5

Section 5 of the Singapore Parliament Elections Ordinance (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —

(a)

by inserting immediately after the word “person'' appearing in the third line of subsection (2) thereof the words “who is a citizen of Singapore and”;

(b)

by deleting the expression “Registration of Persons Ordinance, 1955” appearing in the sixth line of subsection (2) thereof and substituting therefor the expression “National Registration Act, 1965”;

(c)

by deleting the marginal reference “Ord. 32 of 1955” and substituting therefor “Act 11 of 1965”;

(d)

by deleting the words “on the counterfoil of such identity card” appearing in the third and fourth lines of paragraph (b) of subsection (2) thereof and substituting therefor the words “in the register maintained by the Commissioner of National Registration”; and

(e)

by deleting the words “on the counterfoil of such identity card” appearing in the second and third lines of paragraph (c) of subsection (2) thereof and substituting therefor the words “in the register maintained by the Commissioner of National Registration”.

Clause 3

Amendment of section 10

Section 10 of the Ordinance is hereby amended —

(a)

by deleting the figures “1958” appearing in the second line of subsection (1) thereof and substituting therefor the figures “1967”;

(b)

by deleting the expression “Registration of Persons Ordinance, 1955” appearing in the fourth and fifth lines of subsection (1) thereof and substituting therefor the expression “National Registration Act, 1965”;

(c)

by deleting the marginal reference “Ord. 32 of 1955” and substituting therefor “Act 11 of 1965”;

(d)

by deleting the expression “February, 1958” appearing in the eighth line of subsection (1) thereof and substituting therefor the expression “July, 1967”;

(e)

by inserting immediately after subsection (1) thereof the following new subsection:—“(2) Notwithstanding any other provisions of this Ordinance, or any other written law, the Registration Officer shall for the purpose of preparing the first registers of electors for 1967 enter in such registers the names of all entitled persons who are citizens of Singapore and to whom identity cards have been issued or deemed to have been issued pursuant to the provisions of the National Registration Act, 1965, and the regulations made thereunder.”; and

(f)

by renumbering the existing subsections (2) and (3) thereof as subsections (3) and (4) respectively.

Clause 4

Amendment of section 11

Section 11 of the Ordinance is hereby amended by deleting the expression “(3)” appearing in the last line of subsection (2) thereof and substituting therefor the expression “(4)”.

Subsection (3) of section 13 of the Ordinance is hereby amended by deleting the words “been deprived of citizenship” appearing in the fourth line thereof and substituting therefor the words “ceased to be a citizen of Singapore”.

Clause 6

Amendment of section 15

Section 15 of the Ordinance is hereby amended —

(a)

by deleting the figures “1958” appearing in the second line of subsection (1) thereof and substituting therefor the figures “1967”; and

(b)

by deleting the expression “15th day of September or such later date in” appearing in the third and fourth lines of subsection (1) thereof and substituting therefor the expression “31st day of December in that year or such later date following”.

Clause 7

Amendment of section 18

Subsection (3) of section 18 of the Ordinance is hereby amended by deleting the words “been deprived of citizenship” appearing in the fourth line thereof and substituting therefor the words “ceased to be a citizen of Singapore”.

Clause 8

Amendment of section 72

Subsection (2) of section 72 of the Ordinance is hereby amended by inserting immediately after the word “Peace” appearing at the end thereof the words “or a Commissioner for Oaths”.

Clause 9

New section 78A

The Ordinance is hereby amended by inserting immediately after section 78 thereof the following new section:—“Prohibition of dissuasion from voting78A.—

(1)

No person shall between the day of nomination and polling day (both days being inclusive) at any election, by word, message, writing or in any other manner dissuade or attempt to dissuade any person from giving his vote at the election.(2) Any person who contravenes the provisions of subsection (1) of this section shall be guilty of an offence and shall be liable on conviction to a fine of one thousand dollars or to imprisonment for one year.(3) Notwithstanding the provisions of the Criminal Procedure Code relating to the powers of search of any police officer, if any police officer has reasonable cause to believe that an offence is being committed under the provisions of this section, such police officer, by virtue of his office, shall be empowered to enter and search any premises or place for the purpose of ascertaining whether such an offence is being committed.(4) Any police officer may arrest without warrant any person offending in his view against any of the provisions of this section and take him as soon as practicable before a Magistrate's Court to be dealt with according to law.”.

Clause 10

Amendment of Forms in the First Schedule

The First Schedule to the Ordinance is hereby amended by deleting Form Elections 1, 3, 9, 10, 16, 18, 19, 20, 21, 22A and 22B appearing therein and substituting therefor Form Elections 1, 3, 9, 10, 16, 18, 19, 20, 21, 22A and 22B respectively set out in the Schedule to this Act.

Clause 11

Amendment of Second Schedule

The Second Schedule to the Ordinance is hereby amended —

(a)

by deleting the expression “(3)” appearing immediately after the expression “Section 42” and substituting therefor the expression “(7)”; and

(b)

by deleting the title “FORMS OF DIRECTIONS FOR THE GUIDANCE OF A VOTER IN VOTING WHICH SHALL BE EXHIBITED OUTSIDE EVERY POLLING STATION” appearing therein and substituting therefor the title “DIRECTIONS FOR THE GUIDANCE OF VOTERS IN VOTING”.
