Clause 16

by deleting the word “or” at the end of paragraph (a);

by inserting, immediately after the words “from the Agency of any” in paragraph (b), the word “incentive,”;

by deleting the comma at the end of paragraph (b) and substituting the word “; or”;

by inserting, immediately after paragraph (b), the following paragraph:“(c)intentionally alters, suppresses or destroys any document or information which the person is required by the Agency under section 41 to furnish,”; and

by renumbering that section as subsection (1) of that section, and by inserting immediately thereafter the following subsection:“(2) To avoid doubt, it is not a defence in any proceeding for an offence under subsection (1)(a) that the accused did not obtain any incentive, grant or loan from the Agency.”.
