Short title and commencement
This Act may be cited as the Small Claims Tribunals (Amendment) Act 2005 and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Short title and commencement
This Act may be cited as the Small Claims Tribunals (Amendment) Act 2005 and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.
Amendment of section 5
Section 5(1) of the Small Claims Tribunals Act is amended —
by deleting the word “and” at the end of paragraph (a); and
by deleting the full-stop at the end of paragraph (b) and substituting the word “; and”, and by inserting immediately thereafter the following paragraph:“(c)any claim relating to a dispute arising from any contract for the lease of residential premises that does not exceed 2 years.”.
Amendment of section 38
Section 38 of the Small Claims Tribunals Act is amended by inserting, immediately after subsection (1), the following subsections: “(1A) An appeal shall lie to the High Court under this section only if leave to appeal is given by the District Court. (1B) For the avoidance of doubt, leave of the District Court is necessary even if one of the grounds stated in subsection (1) is shown to exist.”.
