Requirements for temporary smoking facilities
Subregulation 1
For the purposes of section 3C(1) of the Act, the prescribed requirements for a smoking facility mentioned in regulation 4 are all of the following:
the smoking facility may only be used for smoking for the purpose of the 2026 exhibition;
the smoking facility must be an enclosed room —
that is independently ventilated;
that is visible and accessible only to registered trade visitors and representatives of tobacco exhibitors;
that contains one or more receptacles suitable for the disposal of cigarette butts or any waste from smoking;
for which a conspicuous sign must be displayed outside the enclosed room stating that the enclosed room is designated for smoking; and
for which air quality control measures are implemented for the purpose of preventing the exfiltration of tobacco smoke, and the effectiveness of those measures is monitored and assessed in accordance with paragraph (2);
entry to the smoking facility for the purpose of smoking is restricted to the following classes of individuals:
an individual whose registration as a registered trade visitor is verified by a representative of a tobacco exhibitor before the individual enters the smoking facility, and who is accompanied by a representative of a tobacco exhibitor when the individual smokes in the smoking facility;
a representative of a tobacco exhibitor who accompanies a registered trade visitor to smoke in the smoking facility.
Subregulation 2
For the purposes of paragraph (1)(b)(v), the effectiveness of the air quality control measures must be monitored and assessed on a real‑time basis by an independent consultant engaged by the organiser of the 2026 exhibition (whether directly or by another person on its behalf), including by monitoring —
the differential pressure between the smoking facility and the area immediately outside the smoking facility; and
the levels of airborne particulates (by what are commonly known as PM2.5, PM4 and PM10) in the area immediately outside the smoking facility compared with the respective baseline levels established before the smoking facility is used for smoking.
Subregulation 3
In this regulation, “smoking” means smoking a tobacco product, or a sample of a tobacco product, provided within the specified place by a tobacco exhibitor during the exhibition period.
