Clause 22

Amendment of Education Endowment and Savings Schemes Act

The Education Endowment and Savings Schemes Act (Cap. 87A, 2009 Ed) is amended —

(a)

by deleting subsection (1) of section 16 and substituting the following subsection:“(1) Where a member of the Edusave Pupils Fund dies, the total amount standing to his credit in his Edusave account shall be paid to the Public Trustee for disposal in accordance with —

(a)

the Intestate Succession Act (Cap. 146), if the member was not a Muslim at the time of his death; or

(b)

section 112 of the Administration of Muslim Law Act (Cap. 3), if the member was a Muslim at the time of his death.”; and

(b)

by deleting subsection (1) of section 16H and substituting the following subsection:“(1) Where a member of the PSE Fund dies, the total amount standing to his credit in his PSE account shall be paid to the Public Trustee for disposal in accordance with —

(a)

the Intestate Succession Act (Cap. 146), if the member was not a Muslim at the time of his death; or

(b)

section 112 of the Administration of Muslim Law Act (Cap. 3), if the member was a Muslim at the time of his death.”.
